Kamloops vets fail in bid to sell inoperable CT scanner with clinic

Two Kamloops veterinarians tried to add thousands of dollars to the purchase price of their clinic with an inoperable CT scanner.

Two former vets at Valleyview Veterinary Clinic agreed to buy the business in 2020, but took the purchase to BC Supreme Court when the former owners tried to add on the price of a inoperable CT scanner.

Dr. Bruce Maricle and Dr. Carla Tobey claimed the scanner added $200,000 to the sale of the clinic, according to a July 13 BC Supreme Court decision.

They paid $41,000 in total for the scanner in 2015, which included $18,000 in "technical services" from the manufacturer. The manufacturer told the owners it wouldn't be useable by 2021 just a month before the former employees offered to buy the clinic.

Despite knowing it couldn't be used the former owners wanted Dr. Heather Fraser and Dr. Carolyn Walsh to pay more than four times its purchase price.

They argued the new owners should pay for the past cost of installing the scanner, which included the removal of three walls and bolting it to the floor.

Justice Steven Wilson ruled the new owners would pay $1.1 million for the vet clinic, which won't include the cost of the aged and inoperable scanner.

He also said Maricle and Tobey have 30 days to have the scanner removed at their own cost if the new owners decide not to keep it.
