Former Kelowna massage therapist being sued for sexual touching

A former Kelowna massage therapist is being sued due to allegations of sexual touching.

Robert Morgan was fined $25,000 after the College of Massage Therapists of B.C. determined he abused his position of power, authority and trust, and misled his patients as multiple instances of sexual touching were reported.

He was found guilty of professional misconduct in June 2021.

A lawsuit filed Feb. 14, against Morgan, the now-defunct Kelowna Medical Massage a Massage Therapist Corporation and ABC Corporation, alleges a woman suffered from psychological damage, anxiety and depression, following an incident in 2015.

She has difficulty sleeping, impaired ability to experience sexual enjoyment and is suffering continuous humiliation and embarrassment, according to the lawsuit.

On Sept. 18, 2015, the woman claimed Morgan massaged her breasts for sexual purposes and failed to provide appropriate draping by lifting the draping exposing her breasts.

“The injuries, loss and damage have caused and continue to cause (the woman’s) suffering, loss of enjoyment of life, and loss of earnings, past and prospective,” according to the lawsuit.

The lawsuit also sites the College of Message Therapists' decision.

Morgan has been banned from applying to register as a massage therapist in B.C. for five years. The decision says the College has the power to determine whether or not Morgan would be reinstated after the five-year ban had expired.

The woman is seeking general, punitive and aggravated damages and costs.

"Since 2017, the RCMP has investigated three complaints of a similar nature," said Cpl. Tammy Lobb with the Kelowna RCMP. 

Morgan has not yet filed a response. None of the allegations have been proven in court and Morgan has not been charged in relation to the incidents.
