Murderer scheduled to make official complaint against Crown

PENTICTON — An ex-RCMP officer and convicted murderer wants a Crown prosecutor removed from his case.

Appearing in Penticton Provincial court Tuesday, Keith G. Wiens said he will be filing an application to have prosecutor John Swanson removed from the case, citing a conflict of interest.'

Swanson didn't prosecute the murder trial; he's prosecuting Wiens on minor breach charges from October, 2011.

When later asked why Wiens wants him thrown off the case, Swanson said: “You’d have to ask him that. I don’t know.”

Wiens is currently serving a life sentence at Kent Institute for murdering his common-law wife, Lynn Kalmring.

Judge Gregory Koturbash told Wiens he would have to pay for the application process, including copies of transcripts from his trial.

“I don’t have money to buy toilet paper let alone transcripts,” Wiens said. 

He will appear again in court on Nov. 4, 2014 for an application.
