Evidence overlooked in home invasion trial: Defence

Three Kamloops men await the judge's decision on charges relating back to a Kemano St. home invasion.

KAMLOOPS — Three men await a judge’s decision on several charges including unlawful confinement, following a targeted North Shore home invasion.

Kamloops Supreme Court Justice Lauri Ann Fenlon is expected to determine April 5 if Joadth Anderson, Travis Kelly, and James Paulin are guilty.

The men are accused of entering Justin Stanley’s Kemano St. home on Jan. 23, 2013, where they proceeded to threaten him with a machete, assault and rob him.

Kirsten Hunt, Stanley’s ex-girlfriend and the fourth member of the masked team, has already served an 11-month sentence for her role, and is currently on probation.

Defence lawyers told Fenlon there was no concrete evidence proving the men were in the house on the day of the invasion, and the lead investigator failed to follow up on relevant evidence pointing to other suspects.

“He was satisfied with where the investigation was headed,” Defence lawyer Michelle Stanford said. "He had his men.”

Crown lawyer William Burrows said witnesses described one suspect as being a "big guy" with "a lumbering limp and deep set eyes." All features possessed by Paulin.

A number of text messages pointing to the men were admitted as evidence, as well as video surveillance.

Police continue to search for Anderson, who failed to appear in court Wednesday morning. He was the only accused not in custody.
