Vernon senior suing for fall in West Kelowna McDonald's parking lot

A Vernon retiree, who claims to have slipped and fallen in the parking lot of a West Kelowna McDonald's, is suing the fast food giant.

Susan Lynn Doble from Vernon, also known as Susan Lynn Dumoulin, filed a lawsuit against both McDonald's Restaurants and McDonald's Restaurants of Canada in the Supreme Court of B.C. on Feb. 1. She claims to have visited the Gellatly Road location in West Kelowna on March 16, 2022.

“As (Doble) was walking across the parking lot towards the entrance door of the premises, she tripped and fell on the asphalt surface, resulting in injury,” according to the lawsuit.

McDonald's is accused of failing to adequately maintain the premises while Doble was in the parking lot. The business ought to have known its property was unsafe, it failed to correct the “dangerous conditions of the premises,” and failed to warn people of “the alleged danger or hazardous condition which it knew or ought to have known existed.”

Due to negligence on behalf of McDonald's, Doble claims to have suffered from cuts to both hands, injuries to both wrists and her left thumb, an abrasion on her right knee, an injury to her hips, an injury to her chest and ribs, and headaches.

As a result of the fall, Doble claims to have experienced, or continue to experience, pain, suffering, loss of enjoyment of life, and has been rendered disabled from performing household duties. She cannot perform some household duties and continues to incur personal services in trust. She will be more susceptible to future injury and degenerative changes, and continues to incur costs for medical care related to the fall.

Doble is seeking money for general damages, special damages, health care costs, and interest – however there is no dollar figure listed. 

McDonald's has not responded to the suit and none of the allegations have been proven in court.
