Repeat Kamloops sexual offender sentenced to 3.5 years in prison

A Kamloops man previously convicted for sexually assaulting his five-year-old stepdaughter will spend more time behind bar for sexually assaulting a different, older stepdaughter from another relationship.

The man, who owns his own business, cannot be named to protect the identity of his victims.

He was sentenced in B.C. Supreme Court to spend 3.5 years in federal prison after being found guilty of sexual assault and sexual touching of a person under the age of 16.

Court heard the now 47-year-old man squeezed his stepdaughter’s breasts and touched her thigh and hair in a sexual manner on three separate occasions in their home between 2016 and 2017, when the girl was between 12 and 14 years old. The teen moved out in 2019 after informing police about the incidents.

Justice Warren Milman noted a separate, sexual assault conviction on a stepdaughter from a previous marriage as warranting a lengthier jail sentence for the latest offences. In 2009, the man was sentenced to three years and nine months in prison for molesting his five-year-old stepdaughter thousands of times over multiple years and inviting a 12-year-old female neighbour in one instance to engage in sexual touching.

The Crown asked for a sentence of four years in prison, while defence counsel suggested a term of 18 to 24 months.

To reduce the risk to other young girls, Milman said he found it necessary to remove the man from society for a lengthy period of time — finding a term consistent with the 2009 sentence appropriate.

“The previous sentence of three years and nine months was evidently insufficient to stop him from reoffending in a similar context,” Milman said.

He said if it weren’t for the man’s history of sexual assault, a lesser sentence would have been warranted, given the limited number of episodes and intrusiveness that occurred.

In addition to prison time, the man will be required to submit a DNA sample to the national criminal database and be barred from attending parks and playgrounds and from working or volunteering in a capacity involving children.
