No jail time for Penticton man who pleaded guilty to drug possession

PENTICTON - Possession of a small amount of methamphetamine didn’t warrant jail time for a Penticton man.

William Craig Hadubiak entered a guilty plea for possession of a controlled substance in Penticton court yeseterday, Feb 27.

Federal Crown Prosecutor Jeremy Burgess told court police attended an address in the 200 block of Westminster Avenue on Oct. 18, 2016 at around 8:30 p.m. and arrested Hudubiak on an outstanding warrant.

While being processed at the Penticton detachment, police found a baggie in his pocket containing 0.95 grams of methamphetamine and he was charged with possession of a controlled substance.

Burgess said Hudubiak had a record of four previous charges, including unlawful confinement and robbery charges stemming from Feb. 15, 2010. With no related possession offences on his record, Burgess asked for a seven day jail term and one year of probation.

Defence lawyer James Pennnington noted his client’s last offence in 2010, suggesting Crown was asking for "a day of jail time for every year Hudubiak had followed the straight and narrow.”

He asked Judge Gale Sinclair to fine his client and give him time to pay it.

Sinclair agreed and handed Hudubiak a $200 fine to be paid by August 31.
