Kootenay seniors' cocaine-fuelled sex life ends in violence, prison

A Kootenay senior whose cocaine-fuelled sex life turned violent has been sentenced to 12 months jail for assaulting his wife.

According to a recently published April 1 B.C. Supreme Court decision, the couple, who'd been married for 39-years, regularly used cocaine during their "special time" and he would physically and psychologically abuse his wife.

The decision said the couple lived in the West Kootenays, she was 66 and he was 69 years old – they are only referred to as D.A. and J.A. in the court document.

The couple spent $800 a week on cocaine and the husband encouraged it as it would allow his wife to speak more openly about her sexual fantasies.

The wife testified that the physical and psychological abuse had gone on for several years.

She said her husband's anger grew with his increasing use of cocaine and resulted from her describing her fantasies about having sex with other men.

In March 2021 through the evening and until about 3 a.m. the couple used cocaine and the husband grabbed his wife by the hair, shook her by the ears, slapped her head, and punched her in the stomach.

The next day she wore a long-sleeved shirt and trousers to work to hide the marks on her body.

When the wife got home from work they began taking cocaine, and the cycle of sex and abuse started again.

This happened over a period of three days.

On day four she left and went to the hospital seeking help.

The wife testified that her husband struck her or pulled her hair an average of 20 to 30 times per day during the three days.

The decision said photographs submitted to the court as evidence show bruising all over her body, including her arms, legs, feet, chest, breasts and back, along with places where hair had been pulled from the top of her head, and a severely swollen left ear.

"She required surgery to stop the bleeding to her injured left ear," the decision reads.

The husband admitted to assaulting his wife on two occasions.

"He testified that the first assaults occurred after his discussions with (his wife) started to become more intense – because (she) continually describing her sexual fantasies to him despite his desire that she stop doing so," the decision said.

The husband testified that on day three of the events in question the couple took cocaine and talked about how things had gotten "out of control."

The court documents paint a picture of a couple who would spitefully verbally attack each other.

At one point the husband threatened to shoot his wife, and another time to shoot himself.

"What is clear is the parties were in a dysfunctional relationship, which at times both sought to exit, but were unable to do so. The evidence suggests that D.A. and J.A. were in a cycle of dependence, which may have been perpetuated by their use of cocaine," Justice Andrew Mayer said.

Justice Mayer found the 69-year-old husband guilty of assault causing bodily harm.

"This assault took place in J.A.’s home – in the bedroom. Assaults against intimate partners, behind closed doors during periods of intimacy, require special consideration," the Justice said.

The Justice sentenced the husband to 12 months jail, which with credit for time already spent behind bars meant he will spend a further 86 days in jail.

Charges of uttering threats and careless storage of a firearm – a loaded rifle was found in his truck – were stayed by the Crown.
