Kamloops dentist fined $25K and banned from sedating patients

A Kamloops dentist has been fined $25,000 and permanently banned from sedating patients by the province's dentistry regulator.

The College of Dental Surgeons of British Columbia found the owner of the Kamloops Oral Surgery and Implant Centre, Dr. Bobby Rishiraj, had provided sedation for one or more of his patients while not operating in compliance with the College's standards.

According to a College decision published Nov. 17, Dr. Rishiraj broke several regulations when practising between May 2018 and June 2019.

Dr. Rishiraj made headlines in 2015 when a patient who attended his clinic to have her wisdom teeth removed went into cardiac arrest and subsequently sustained a severe brain injury.

Dr. Rishiraj ultimately admitted to providing deep sedation when he was not approved to do so and was fined $50,000 and placed under certain restrictions for five years.

In April 2019 when the College inspected his dental surgery, it found further problems.

The regulator found issues surrounding the emergency mobile cart at the clinic and that some medications were not clearly identified. The cart contained drugs that were not current, the cart was missing required medication and essential airway equipment, and the cart was disorganized, preventing expedient retrieval of medication and equipment.

The College also found some members of Dr. Rishiraj's staff had either let their registrations expire or were not appropriately qualified or adequately trained to assist with sedation and manage medical emergencies.

According to the decision, Dr. Rishiraj also failed to maintain sedation records and store and log drugs correctly.

Dr. Rishiraj, who has been registered as a dentist in B.C. since 1995, admitted to professional misconduct and signed a consent order.

He is now permanently prohibited from providing any level of sedation services in any dental facility in B.C. and is not allowed to act as the operator or director of Kamloops Oral Surgery and Implant Centre.

He is, however, allowed to continue to practice dentistry but not with sedation.

The College fined Dr. Rishiraj $25,000 plus $4,000 for costs.
