Kamloops cop fired for having affair on duty loses appeal

A Kamloops RCMP officer who was fired for having an extramarital affair while on duty has lost an appeal to get his job back.

According to a recently published May 5 RCMP Conduct Board decision, Kamloops RCMP Const. Ashley Goodyer appealed a 2018 decision when he was ordered to resign and fined 20 days' pay for having an affair during work time and lying about it to his supervisors.

The decision said Const. Goodyer was a rookie cop in 2016 when a colleague noticed his police cruiser parked outside of a house in Kamloops well away from the area he was supposed to be patrolling.

He admitted he was having an affair with the woman at the address. The police officer said the affair had started in the summer of 2016 but claimed it had ended in September – shortly before he got married.

The officer was told by his superiors not to visit the woman's house while he was on duty and that doing so might bring the reputation of the RCMP into disrepute.

A little while afterward, he asked his boss if he could pay a brief visit birthday party of one of his wife's friends while on duty. His boss agreed.

However, it then later transpired that he had never been to the party and had instead gone to see his secret lover.

He then lied to investigators and only admitted there was no party when the investigator said they were going to call his wife and check.

In November 2017 Const. Goodyer was suspended with pay facing five allegations.

The RCMP accused him of failing to follow orders by going to the house of the woman he was having an affair with.

He was also accused of engaging in sexual, intimate or romantic activity with the woman while on duty.

The other three allegations all involve being dishonest to his superiors while having the affair.

Const. Goodyer was also found to have lied to the RCMP Code of Conduct investigator looking into the case.

The Conduct Board found the Kamloops cop had committed each allegation but didn't prove he'd had sexual activity with the woman while on duty.

In his appeal, Const. Goodyer argued the Conduct Board had made various mistakes in deciding to have him fired.

The police officer argued the Board breached procedural fairness rules, and that an assessment mitigating and aggravating factors didn't meet the required legal standard.

He also argued it had failed to assess the credibility of support letters he submitted.

However, four years after he was originally ordered to resign the conduct board again made much the same decision.

"The Board determined that (the) allegations... collectively made it untenable for the (Goodyer's) employment with the RCMP to continue," the Conduct Board ruled.

The Conduct Board did however decide that the 20-day forfeiture of pay should be dismissed.

The decision said if Const. Goodyer isn't happy with the result he can appeal it through the Federal Court.
