Guilty plea to child porn charge in Kamloops Supreme Court

For possessing child pornography a B.C. man will likely be sentenced to a year behind bars.

Kevin Victor MacLeod pleaded guilty on June 29 to the charge in the Kamloops Supreme Court where he attended by phone. 

He faced three other more significant charges, including sexual interference of a person under the age of 16, an invitation to sexual touching of a person under 16, and making or publishing child pornography, but Dan McLaughlin, communications counsel with the BC Prosecution Service, says it those charges will likely be stayed.

The court heard that MacLeod possessed child pornography from May 26, 2013 to March 3, 2018.

Supreme Court judge Dev Dley ordered a psychological evaluation to be included in the pre-sentence report. MacLeod is currently getting treatment from a local psychologist while on bail, according to his defense counsel Cameron Johnson.  He added that MacLeod would like to turn himself in as soon as possible to begin serving out the sentence he’ll receive.

“If we were having in-person court he would surrender himself today, but we don’t have the ability to do that today. So we’d like to ask for the direction of the court as to how Mr. MacLeod surrenders himself to go to (Kamloops Regional Correctional Centre),”  Johnson said.

“Mr. MacLeod is facing a mandatory minimum of one year, there’s likely to be almost certainly a joint submission on sentence and there’s no charter application so he is going to get a custodial sentence and given the circumstances with the conditions he’s on, it makes the most amount of sense for him to be in custody.”

It was not made clear during the court session what would be the best method for MacLeod to turn himself in.

The date for MacLeod’s sentencing has been set for Aug. 24.
