Couple takes WestJet to court in Penticton for 'mental distress' from cancelled flight

WestJet is being sued for cancelling a flight back to B.C. from Mexico after a couple was forced to spend an extra day down south.

Richard and Susan Thompson are taking the airline to Penticton small claims court, seeking $10,436, mostly for their "mental distress" of having to pay out of pocket for their extended stay.

The Thompsons were to stay in Mexico for two weeks before returning to Victoria on April 23, 2022, but their return flight was cancelled because a crew member fell sick, according to court documents.

"The (Thompsons) incurred expenses due to this cancellation including, but not limited to, an overnight stay in San Jose del Cabo, transportation from and returning to the airport, and additional meals," court documents read.

They were booked onto an April 24 flight, but didn't get the "premium economy" amenities they paid for, like priority boarding, meals and beverages, according to their claim.

They're seeking $1,000 each for federally regulated passenger compensation, $836 for their accommodation and another $100 because WestJet failed to provide meals.

The largest item on the $10,000 claim is $7,5000 for mental distress.

"As a result, (WestJet's) callous disregard for the wellbeing of its passengers and failure to communicate, the (Thompsons) suffered significant mental/emotional distress," court documents read.

Their claim goes on to say WestJet used "delay tactics" and failed to give any refunds or compensation.

The Thompsons' claim was filed at the Penticton courthouse on Feb. 28. None of the claims have been proven and WestJet has not filed a response.
