B.C. doctor ordered to pay $3,000 after tirade against human rights tribunal staff

A B.C. doctor who called a B.C. Human Rights Tribunal member a "shameless and stupid woman," and used multiple profanities and threatening language, has been ordered to pay $3,000.

According to a Feb. 10 B.C. Human Rights Tribunal decision, the doctor's behaviour was "extreme" and "deliberate" and at one point he called the Tribunal "a joke."

The doctor's name and the health authority he worked in are redacted in the decision, which said the doctor originally launched a B.C. Human Rights case against his former employer.

The decision said the doctor received negative feedback from his supervisors which led the health authority to withdraw its sponsorship of him, which in turn meant he lost his job and ability to practice.

The doctor then launched a Human Rights Tribunal case against the health authority arguing it had discriminated against him because of his race.

However, when the Tribunal asked the doctor for paperwork for his case things started to fall apart.

"During the complaint process, (the) doctor has not complied with the Tribunal’s disclosure orders, communicated disrespectfully with the Tribunal and other parties, and ignored the Tribunal’s directions about his communications in the proceeding," the decision read.

It's not clear what triggered the doctor's outburst but over multiple emails, he called a Tribunal staff member a "clueless... stupid woman."

"Madam you should have some shame and resign from this case. You are not fit to pass judgment on it," the doctor said in one email before going on to call the Tribunal "a joke."

He was also rude to the health authority's lawyers calling them "incompetent" and "ignorant" and saying they had "no moral qualms" about defending a "filthy racist institution."

He then went on to threaten the lawyers with "unimaginable humiliation" and called a Tribunal staffer "corrupt and incompetent" and a "shameless and stupid woman."

The Tribunal issued five warnings to the doctor, but he ignored them.

"(The) doctor referred to the Tribunal, other parties and their counsel using language including, 'petty circus.' 'scumbags,' 'evil liar,' 'corrupt incompetent waste of time circus,' 'shameful,' 'pathetic' and 'shitshow,'" the decision said.

He made lavish statements saying there would be a book and documentary coming out about what was happening.

He also made threatening comments.

"The implications for stupidity and negligence, in dealing with my case, are going to come back to haunt the Tribunal in ways it cannot imagine at this stage," the doctor said in the decision.

Ultimately, the health authority argued the doctor should pay $3,000 costs before the case had even gone to a hearing.

The Tribunal agreed.

"The conduct at issue was extreme, repeat, and deliberate. (The) doctor repeatedly rejected the Tribunal’s orders, directions, and warnings," Tribunal Member Kathleen Smith said in the decision. "Further, he expressed an intention not to comply in the future. In fact, his communications in response to this very application were improper and exhibited the very behaviour for which I am now sanctioning him."

"The Tribunal offered multiple warnings and opportunities to change course. Not only did (the) doctor refuse to change his behaviour, but he continued it. In all these circumstances, a costs award of $3,000 is appropriate," the Tribunal ruled.

While the decision doesn't give a location, it said the doctor is still practicing in B.C.

His case against the heath authority is also still proceeding, provided he follows the rules.
