BC woman borrowed money from friend to bury husband, then claimed it was a gift

A BC woman has to repay a friend more than $3,500 after she couldn't afford her husband's funeral costs more than two years ago.

Camella Lynn Cox needed $3,475 for her husband's funeral expenses in May 2021, for which her friend Deborah G Taylor paid for instead, according to a recent BC Civil Resolution Tribunal decision.

Cox told Taylor she would repay the money once her husband's CPP death benefit was paid, but Cox followed up two times when she still didn't see the money.

On June 14, 2022, Taylor sent a demand letter to Cox, but there was no response. However, Cox claimed Taylor said "not to worry" about the expense.

The Tribunal found no evidence the money was intended to be a gift and that it was intended to be a loan.

Cox should have mentioned in her responses whether she had received her husband's death benefit, but the Tribunal decided it is "likely" she's received the funds.

The Tribunal gave Cox a month to repay Taylor a total $3,780, which includes the $3,475 loan, legal fees and interest.
