Kamloops area realtors fined over undisclosed bylaw infractions

Two Kamloops area realtors involved in the sale of a Lillooet property that had zoning bylaw infractions registered against it have each been fined $5,000.

Lillooet realtor Dawn Marie Mortensen, who listed the property, and Kamloops realtor Jeremia Oscar William Huxley, who represented the buyers, were both issued $5,000 fines by the BC Financial Services Authority.

According to two separate July 2 BC Financial Service Authority penalty notices, Mortensen listed the Lillooet property in August 2022.

The regulator said Mortensen failed to act with reasonable care and skill.

"You were aware of the zoning bylaw infractions and allowed sellers to provide an inaccurate Property Disclosure Statement, did not have sellers amend the Property Disclosure Statement, and did not create an addendum to reflect the appropriate disclosure," the penalty notice read.

Huxley failed to do his "due diligence," the regulator said.

"(Huxley) failed to use reasonable efforts to discover relevant facts respecting the outbuildings, zoning, and bylaw infractions registered with the District of Lillooet," the penalty notice read.

The regulator said that neither Huxley, who is a representative for Century 21 Assurance Realty, or Mortensen, who works under the Royal LePage Westwin Realty banner, don't have any other disciplinary history.

There's no mention in either penalty notice of what happened regarding the sale, or whether there were any financial repercussions because of the bylaw infractions.

The realtors were given 30 days to appeal or pay the fine.

No other information is given in the notices.
