Trial dates for Nelson Hart set for February in alleged prison incident

ST. JOHN'S, N.L. - A man released from prison after murder charges were dropped in Newfoundland and Labrador will be back in court in February to face trial on charges of uttering threats and assaulting a peace officer.

Nelson Hart wasn't in court Friday when Feb. 17-19 was set to deal with a related Charter of Rights application and a two-day trial in provincial court in St. John's.

He has pleaded not guilty to charges involving an alleged incident at Her Majesty's Penitentiary in June 2013.

He was convicted in the drowning deaths of his three-year-old twin daughters in Gander, N.L., in 2002.

But the Crown recently dropped first-degree murder charges against Hart.

The move came after the Supreme Court of Canada upheld an appeal of his 2007 conviction, ruling that confessions Hart made to undercover Mounties during a sting operation couldn't be used against him.
