Longer sentence for Kamloops man who had sexual relationship with underage neighbour

KAMLOOPS - A Kamloops man who admitted to having a sexual relationship with his underage neighbour will spend 18 months behind bars.

His jail sentence comes months after a Supreme Court judge struck down a joint submission by Crown and his defence lawyers for a one-year jail sentence.

"(We) tried to see what we could do to address your honour's concerns," Crown prosecutor Catriona Elliott told Supreme Court judge Dev Dley.

During a previous sentencing hearing, Dley said the circumstances of the offence, including egregious facts and a breach of trust warranted a sentence longer than 12 months.

Elliott told the court today, June 22, that she and defence lawyer Micah Rankin had agreed on a new joint submission for an 18-month jail sentence which Dley accepted.

The offender, who's in his 60s, admitted earlier this year to having a sexual relationship with his underage neighbour. He pleaded guilty to sexually touching the young girl, directly or indirectly.

He cannot be named to protect the identity of the victim.

Court has heard that the victim's mother discovered text messages on her teenage daughter's cell phone in 2015, depicting a year-long relationship with the next door neighbour. At the time the messages were discovered, the girl was 17 years old and the man was 61, but their relationship had began in 2013.

Their relationship began when the girl was 14, but sexual intercourse began when she turned 15. The relationship was ongoing until the discovery of the text messages.

Court heard the man would babysit the victim's younger siblings and the victim would go to his house with them.

Crown didn't ask for a probation order following the man's release, but he will have to give a sample of his DNA to the national database and he will be a registered sex offender for 20 years.
