Child porn charge nets Penticton man 90-day sentence

David Thorp, 57, was sentenced to 90 days in jail on Monday for pleading guilty to a child pornography possession charge.

PENTICTON - A Penticton man will not have to spend Christmas in jail for possessing child pornography as his 90-day intermittent sentence will be served on weekends.

David Thorp, 57, was in Penticton Provincial Court on Monday after pleading guilty to one count of possession of child pornography. Judge Gale Sinclair checked his calendar before sentencing the man. Dec. 25 and New Year's Day fall on a Wednesday so Thorp will not have to spend the holidays as a guest of the Penticton RCMP detachment. Thorp will serve his time on the weekends starting this Friday.

Charges of accessing child pornography and two counts of importing or distributing child pornography were stayed.

Thorp declined to speak when offered the opportunity.

Sinclair called the sentence an appropriate one and chastised Thorp for his actions.

"If you wouldn't look at this stuff it wouldn't be made," the judge said.

Thorp, who is on a fixed income, will have one of two computers returned to him. The other machine where the child porn was found will not be returned.

He will also serve a two-year probation period following his sentence. The judge ordered him to avoid people 16 years of age or less, submit to a DNA sample and be on the National Sex Offender Registry for a period of 10 years.
