Admitted child pornographer opts to start sentence early

KELOWNA - A man who admits to making child pornography in 2007 and 2008 has opted to go into custody early.
 
David Gerald Smart, 42, pleaded guilty to making and possessing child pornography in Kelowna and Cranbrook between Nov. 1, 2007 and Jan. 31, 2008.
 
Charged in August 2013, Smart was granted bail and released, but on Tuesday his lawyer, Andrew Vandersluys, told a provincial court judge his client wanted to get started on his sentence as soon as possible.
 
"He has instructed me in no uncertain terms he wishes to be taken into custody," Vandersluys said. "He knows he is facing a custodial sentence in this matter and would like to begin."
 
According to court documents and Global Okanagan, this is not Smart's first court appearance. In 2010 he was charged with molesting the eight-year-old daughter of his girlfriend but acquitted because the judge found her testimony inconsistent.
 
A pre-sentence and psychiatric report were ordered ahead of his next court appearance Dec. 16.
